Examining Bilateral Labor Agreements for Filipino Nurses
Abstract: This paper examines the use of bilateral labor agreements (BLAs) as a policy instrument to manage the migration of Filipino nurses abroad. Taking BLAs as the subject of justice in the Rawlsian sense, the paper explores the ethical implications of Filipino nurse migration as outlined in two BLAs namely 1) the Germany-Philippines Triple Win Project and 2) the Japan-Philippines Economic Partnership Agreement. The paper argues that Rawls’s principles of justice namely the principle of equal liberty and the principle of democratic equality determine the moral acceptability of BLAs entered into by the Philippine government. In congruence to the demands of international justice, the paper further argues that the principle of duty of assistance is a shared political responsibility to be carried out both by the sending and the receiving countries in order to cushion the impact of health worker migration especially the adversely affected population left behind.
